Euro Car Parks lose in court !
Well, it took a while, but here we are.
They took me to court for "£2,560", and yesterday, the judge quite correctly dismissed the case.
- No evidence of contract between Sainsburys and ECP
- No witness statement
- Nothing to show the claimant has the right to issue proceedings
- No proof of system of data collection, no evidence to show the cameras were working and that it's safe to rely on their evidence
- No proof of breach of contract
- No submission of of evidence of quantifiable losses, therefore their ludicrous "parking charge notices" are nothing more than unenforceable penalties
I cannot thank this forum and the Pepipoo one for everyone's support and chiming in. In particular I must thank Alexis, who has been a staunch ally in this, right up to the last. Also thanks to Matthew for his early advice.
You will be proud to hear that they even submitted a print off of my original enquiry here as part of their bundle, not entirely sure how it would help, but they are clearly daunted by the coaslescing of common sense to be found here.
So what can I pass on from the experience ?
Use your common sense.
Don't be intimidated by this kind of unregulated, these illegal demands for ludicrous sums of money. Ignore them. But then most of you knew that already.
