Dodging TV licence will not be a crime
It will no longer be a criminal offence to refuse to pay the TV licence fee, under radical plans being backed by ministers.
Currently, anyone failing to pay the licence fee who watches live television at home faces a fine of up to £1,000 and a criminal record. Those who refuse to pay any fines they are given by a Magistrates Court ultimately face jail.
More than 100 backbench MPs from all the major political parties are now supporting a change in the law which would make non-payment of the annual £145.50 charge a matter for the civil courts, rather than a criminal offence.
This would mean nobody who fails to pay could be given a criminal record, although penalties, including potential fines, would still apply.
The Telegraph can disclose that Chris Grayling, the Justice Secretary, and Maria Miller, the Culture and Media Secretary, both now support the idea.
Teams of Whitehall officials will begin working on detailed proposals for how to bring about a change in the law.
However, the reform will be fiercely resisted by BBC executives, who argue that it will increase licence fee “evasion” and lead to a significant fall in the funding available for the broadcaster.
According to the most recent figures, about 70 people a year are jailed for TV licence fee offences. But the scale of prosecutions for licence fee evasion is far higher and now accounts for one in nine of all Magistrates Court cases.
More than 180,000 people – almost 3,500 a week – appeared before the Magistrates Courts in 2012, accused of watching television without a valid licence in, with 155,000 being convicted and fined.
The figure has been rising in recent years as TV Licensing, which is responsible for catching “evaders”, has adopted a more determined and effective approach.
Ministers are now concerned at the huge burden these cases place on the criminal courts.
Mr Grayling, the Justice Secretary, told The Daily Telegraph: “The Culture Secretary and I both agree that this is a really interesting idea - particularly given the pressure on our courts system. Our departments will be doing some serious work on the proposal.”
The reform could become law within months as a growing number of backbench MPs supports an amendment to the coalition’s Deregulation Bill, which is currently passing through Parliament.
The amendment would delete references in the 2003 Communications Act to licence fee evaders being “guilty of an offence” and state instead that individuals who refuse to pay the charge will be “liable to a civil penalty”. The level of any fine would be determined by the government of the day, under the plan.
The amendment has been backed by 101 MPs from all the major parties, including the former Liberal Democrat leader, Sir Menzies Campbell, David Davis, the former Tory shadow home secretary, and Frank Dobson, Labour’s former Health Secretary.
Andrew Bridgen, the Consevartive MP for North West Leicestershire, who tabled the amendment, said the wide support his proposal had received showed that the government should support it.
“For those in real hardship who cannot pay the television licence fee, the current legislation is effectively criminalising them for being poor, which cannot be right,” he said.
“I and many colleagues feel that the non payment of the TV licence being a criminal offence is disproportionate.
“The current funding arrangement for the BBC is a Poll Tax and is one of the most regressive forms of taxation. Most of those sent to prison as a result of non payment are the elderly and women and this serves no purpose and the huge associated costs are borne by the taxpayer.”
Government sources said ministers were considering whether it would be possible formally to support Mr Bridgen’s amendment when it comes to a Commons vote.
However, a source at the Department for Culture, Media and Sport said Mrs Miller would prefer to wait until the BBC’s Charter, which determines its funding, is renewed in 2017 before changing the way the corporation is funded.
The source said: “The Culture Secretary supports the idea in principle but the timing of this issue is vital. Maria will put decriminalisation of the licence fee on the table during Charter Review discussions, but to do it beforehand would waste an opportunity.”
A BBC spokesman said: “Legislation is a matter for the Government, however changing the law could lead to higher evasion. Just a 1 per cent increase in evasion would lead to the loss of around £35million, the equivalent of around 10 BBC Local Radio stations.”

The BBC should have been the first thing to privatize and then drop the tv license and make it compete like everyone else.

Instead they are now looking to privatize aspects of the NHS by the back door.

It's full of fucking closet Tories, snobs and monarchist sychophants anyway. A right little cushy number for "well-connected" Oxbridge's least talented "as seen on the Fringe and Footlights" for decades. That is probably why they didn't privatise it. Some mewling toff pleading with his more powerful cousin that he just can't do away with Auntie Beeb and Ovaltine and the Archers!

I can't dispute any of that Mikey but I think the BBC works in a different way

It's almost a given that the masses expect these other broadcast/publishing entities to have some sort of agenda/motive in their output.

However, the BBC have carefully cultured their image as a state broadcaster that is impartial and honest in its product. People like us know this is bollocks but the average Brit man/woman on the street has that perception and especially in older generations that belief is almost universaly accepted and very difficult to be convinced otherwise.
So it's really about perceptions rather than reality.
People trust Aunty Beeb - its a comfort blanket for those who don't want to face the more unpleasant realities in life. Only state trusteeship can be entrusted with that, potentially very powerful, responsibility. Also don't forget BBC World projects a very carefully controlled image of Britain around the world.
The BBC is the master of and envy of state propogandists around the world. No other state had the powerful subtlety of the BBC. The Nazi's, master propogandists they were but the carrot is always bette than the stick. This was evidenced by the resounding success of the BBC in the propoganda war.

Where I differ is your assertion that alternative private media sources are viewed as biased.

If the previous decade is anything to go by, its that FOX News, even when it had to win the legal case for lying on air, they were hailed by a large proportion of the population as the only reliable new source.

Media regulator Ofcom's report shows television is the most important platform for news, with 34% of adults turning to BBC1

More than half of people in the UK regard the BBC as their single most important source of news, according to new figures released by media regulator Ofcom.

The report said television remained by far the most important platform for news, used by 78% of adults against 40% who read newspapers, 35% who turn to the radio and 32% who look to the internet.

The BBC website remains the most popular online destination, used by 52% of people who go online, against 19% of people who use Facebook and 10% who turned to Twitter for online news updates.

While Twitter was praised for the range of opinions it offers, more than any other named source across any media, less than a third of people who used it regarded it as accurate (29%) or trustworthy (28%), said Ofcom.

There was a big age differential, with 12% of people aged 16 to 24 using the internet for news, against 1% who went online among the over 55s, according to the News Consumption in the UK report published on Wednesday.

Asked to name their single most important source for news, 34% of respondents said BBC1, followed by ITV (13%) and 6% who said the BBC News channel, just ahead of Sky News (5%) and the BBC website, also 5%.

In total, 53% of people regarded one of the BBC's news outlets, across TV, radio and online, as their most important source of news.

But while BBC TV was regarded as important, its viewers scored it marginally lower in terms of accuracy and reliability, and trustworthiness, than viewers of Sky News.

Asked whether it was impartial and unbiased, and offered a range of opinions, BBC TV scored less highly (among their respective viewers) than Sky News, ITV and Channel 4 News. Channel 5 News rated worst among the TV news services.
This is pretty depressing because what it implies is that even though people don’t regard the BBC as reliable they still watch it anyway. I know that it’s not remotely reliable, that’s why I don’t watch it, that would seem to be logical.

People watch the BBC even if they know it is not reliable due to its high production standards I reckon. There's nothing worse than watching some poorly produced drivel. It makes for difficult viewing and probably stops you from relaxing.

No statistics though for how many people who don't invoke the WOIRA just laugh and shut the door in their faces after they have announced who they are. :chuckle:

As long as they don't change what powers these so called "enforcement" officers can do re entering your house then this won't make much difference to those in the know, the bigger concern is what they will do after the election whoever wins. Not happy bunnies that so many are not paying quite legally I'm guessing they'll look at what Ireland is trying to do and introduce some kind of broadcasting tax:
